Sol Hus Booking Terms and Conditions

These Terms and Conditions constitute a legal agreement between you (“you” or “the

Customer” or “Guest(s)”) and SOL HUS COMPANY PTY LTD (ABN 85 666 701 444)

(“we/us” or “the Provider” or “Sol Hus”).

 

By clicking “I agree” (or similar button or checkbox) or by booking through this website, you indicate that you agree to be bound by our terms and conditions, which consist of the terms below, our Terms and Conditions, Privacy Policy and Website Terms of Use (Agreement). If you do not agree to this Agreement, please do not visit our site or make any payment for our offerings. 

 

This website is provided on an “as is” basis. All material displayed on our website is provided without any guarantees, conditions or warranties as to its accuracy, reliability or completeness, nor that it will meet any particular results, requirements or expectations.

 

Please be aware that the terms of this Agreement are only applicable for bookings made through this website. All reservations made through third-party platforms will be subject to its own terms and conditions and which will govern your reservation. It is your responsibility to review and comply with those terms.

 

We do not endorse or recommend any specific third-party provider. We are also not

responsible for the content of those third-party platforms, and do not make any

representations or provide any guarantees or warranties regarding their content. Your use of these third-party platforms is entirely at your own risk and subject to their relevant terms of booking.

 

Our Tiny Homes

 

Our accommodation provides guests with an opportunity to book and stay in uniquely

designed tiny homes, intended for relaxation, disconnection from the digital world, and

exploration of the natural beauty of Kangaroo Island. The Services are designed to cater to individuals seeking a personal and intimate experience with nature, aiming to enhance well- being, promote environmental sustainability, and offer a tranquil retreat from everyday life.

 

By making a booking through our website, you and all of your guests voluntarily assume all risks associated with your accommodation at our tiny homes, and do so of your own free will and accord. We are not responsible for any injuries, accidents, illness, harm, loss or damage suffered in connection with your stay at our tiny homes.

 

Before making any booking, you agree that you will ensure that you understand and conduct your due diligence to ensure that the accommodation is suitable for your use, which is to only be of an individual and personal nature.

 

You are not permitted to use our accommodation on a commercial basis without notifying us in writing and obtaining our written consent.

 

Deposit and Payment

 

The prices for our accommodation are inclusive of GST and set out on our website (which may change from time to time).

 

50% of the total booking value is required at the time of booking to secure your reservation at Sol Hus, the remaining balance is due 7 day(s) before arrival.

 

We use a secure third-party payment gateway to process your online payments. It is your responsibility to familiarise yourself with the terms and conditions of this third-party before making payment.

 

All bookings are subject to a credit card surcharge of 1.75% plus 30 cent booking fee. This fee will be applied when the payment is processed.

 

From time to time, we may issue you an invoice for payment for the provision of our good and services to you. If you do not pay our invoice in accordance with its payment terms, we reserve the right to add interest at the rate of 10.00% per annum in addition to any further and reasonable costs we incur to recover those fees from you.

 

Acceptance of Booking

 

You will receive an acknowledgement email confirming receipt of your booking upon our

receipt of the booking deposit Receipt of payment will be deemed accepted until that form of payment has been honoured, cleared or recognised.

 

Your booking will not be binding until you receive email confirmation that your deposit and reservation dates have been accepted and received by us.

 

At any time prior to your booking being accepted in accordance with these terms, we reserve the right in our full discretion to suspend, cancel or refuse the booking, including refusing to accept any future bookings.

 

Bond

​

A $300 refundable bond is required to cover any damage incurred to the property or

incidental to your booking and stay at the property, including any breach or default of these terms.

 

Subject to your compliance with these terms and Sol Hus’ policies, this bond will be pre-

authorised on your credit card at check-in and released within 7 days of check-out.

 

General Caution

As a guest of Sol Hus, your safety is your responsibility. We encourage you to exercise common sense, especially in interactions with wildlife and use of the fire pit. Sol Hus and the property owners are not liable for personal injury or damage to personal property, including vehicles and personal belongings. By booking with us, you acknowledge your responsibility for your belongings.

Stay Lengths

A minimum stay of two nights is required. Single-night stays may occasionally become available and will be offered at our sole discretion.

Cancellation by You

You must provide at least thirty (30) days written notice by way of email to us before your arrival if you wish to cancel or change your booking dates.

 

Subject to us receiving written notice above, and in the event of a cancellation, we will

provide you with a refund in the sum of your booking fee less 5%, of which amount will be retained by us as an administrative cancellation fee.

 

Should provide less than thirty (30) days written notice of a booking cancellation, we may offer you an alternative booking date or credit note at our sole discretion. While we will do our best to find an alternative booking date, we cannot guarantee that we will be able to change your booking to your next preferred date and time.

 

We strongly recommend purchasing travel insurance to cover unforeseen circumstances.

 

All fees paid or payable to us will be forfeited in the event of a no show to your booking.

 

You will be responsible for any and all loss or expenses incurred by you as a direct result of your booking cancellation.

 

Cancellation by Sol Hus

If we must cancel your booking, you can transfer the amount paid to an available alternate date or receive a full refund without any further liability to you, unless the cancellation is due to a Force Majeure Event. Please note for bookings during fire danger seasons, Sol Hus reserves the right to cancel bookings in compliance with local fire bans and severe weather warnings in accordance with cancellations due to a Force Majeure Event below.

 

Cancellation due to Force Majeure

Any circumstances beyond the reasonable control of the parties shall be deemed a ‘Force Majeure Event’. This includes, but is not limited to, natural disasters, wars, strikes, lockouts, governmental or quasi-governmental restraints, and any act of God.

 

In case of cancellation due to a Force Majeure Event, we offer:

  • A 100% credit of monies paid, or

  • A refund minus all reasonable fees and expenses incurred by Sol Hus incurred as a result of the cancellation.

 

If the Force Majeure Event occurs after your stay has commenced, we offer a pro-rata credit or refund for the remaining days.

Liability

To the maximum extent permitted by law, you agree to irrevocably indemnify and hold us and the landowner harmless from and against, and we exclude all liability for, all claims, actions, injuries, loss and damages that you may suffer in connection with or arising from your stay at our accommodation, from your breach of this agreement, or your (or your Visitor’s) negligence, misconduct or recklessness, including any of your breach of law or the rights of any third party, and the acts or omissions of any third-party suppliers.

 

We, including our representatives, employees, agents and contractors, are not liable for any claim, loss, damage, harm (including consequential damage such as loss of opportunity, revenue or savings) or any similar damages arising from delays out of our reasonable control, or in relation to your use of our website, information supplied, including any errors or omissions in our material or content.

 

To the maximum extent permitted by law, we expressly disclaim and do not make any

representations made in relation to our accommodation services (whether express, implied, statutory or otherwise) in relation to their merchantability, fitness for a particular purpose, non-infringement of third-party rights, its accuracy, reliability, completeness, currency, the availability, or that you will achieve any particular results.

 

By accepting this agreement, you (the Guests), your Visitors (if applicable) acknowledge that you will absolve us and the landowner from any and all liability set out above.

 

You must not disparage us in any way, whether directly or indirectly, verbally, in writing,

online or otherwise, and must also take all reasonable steps to prevent your Visitors and

representatives from the same.

 

Depending on the circumstances, seeking an order for damages may not be a suitable

remedy, therefore, such party may obtain an injunction restraining the other from breaching this Agreement (and any other equitable relief) as they see fit.

 

Termination

 

​Ether party may terminate this agreement by providing five (5) days’ written notice to the

other party if a party commits a serious breach of the Agreement or threatens to breach this Agreement.

 

In the event that you commit a persistent or serious breach of this Agreement, mislead us in any way, or are negligent, fraudulent or engage in any act or omission of wilful misconduct, we reserve the right to immediately terminate this agreement, re-enter and repossess the premises, seek compensation for any loss or damage suffered as a result of your breach, and exercise any other right under this agreement.

 

In the event of any termination of this agreement and for any reason whatsoever:

 

(a) you will remain liable to pay all fees and amounts payable up to the date of

termination or cancellation;

 

(b) if you are, at the time of termination, at or on the property, you must immediately

vacate and leave the property in a neat and tidy manner;

 

(c) you will be further liable for any expenses and fees incurred by us to terminate and

exercise our rights under this agreement in the event of a termination for breach by

you; and

 

(d) this will not affect any of our other rights under this agreement, including the right to

refuse any future bookings or visits to the property.

 

General

 

This Agreement will contain the entire understanding between the parties.

 

If any term of this Agreement is invalid, void, illegal or unenforceable, it will be read down or severed, and the remaining provisions shall continue to be enforceable and valid. 

 

Any waiver of a right must be signed in writing by both parties.

 

We may vary the terms of this Agreement, and which will apply after those terms are

published on our website. You are responsible for reviewing and checking these terms

before making your booking.

 

You must not assign or transfer your booking or order without our written consent.

 

We will provide you written notice if we assign our rights under these terms.

 

The laws and jurisdiction of South Australia will govern this Agreement. Your consumer

rights are not affected by these terms and conditions.

 

House Rules for Your Stay

 

Weather Considerations

 

Please consider the seasonal weather when booking, as we do not offer refunds or

cancellations due to weather conditions. In extreme conditions, the ferry will be cancelled. We recommend taking the earliest ferry’s available in winter.

 

Facilities and Equipment

 

Sol Hus is off-grid, and while we strive to maintain essential services, we recommend bringing necessary items. Inoperative or defective equipment should be reported for prompt repair, but no rent reduction or rebate will be issued for mechanical failures.

Campfires

​

Strict adherence to local fire regulations and bans is mandatory. On declared fire ban days, the use of the fire pit is strictly prohibited. Guests will be notified by Sol Hus when such bans are in effect and are required to comply with all provided instructions. Under no circumstances are guests permitted to collect firewood from the property. Failure to adhere to these fire safety regulations may result in immediate eviction from the property without any entitlement to a refund.

Location

 

Sol Hus reserves the right to move the location of your accommodation as needed under any circumstance.

​

Guest Damage and Site Considerations

 

Guests are liable for any damages caused during their stay. Please observe all safety considerations.

​

Preparation and Arrival

Familiarise yourself with Sol Hus policies and check-in instructions prior to arrival. Contact us at hello@solhus.com.au if you have any queries prior to checking in. You are responsible for any potential damages incurred by yourself or any guest travelling with you.

​

All bookings are for two people. If you require extra bedding and bed linen for extra guests you must notify Sol Hus prior to your arrival.

​

Check in

 

Check in is from 3pm. Note that Sol Hus may be difficult to locate, try to avoid arriving after dark. You must access the location via the supplied directions. You must not attempt to drive off the supplied route and you will be responsible for all losses and damages incurred by not following the directions supplied. Roads and tracks not designated may not be suitable for 2WD and may cause damage to vehicles.

Departure

Leave the property clean and tidy, place all waste in the respective bins, and follow the check-out procedures as detailed. Food scraps and cigarette butts must not be thrown anywhere on the property to protect wildlife. Leave by the approved route only.

 

Any abandoned goods or property left on the premises by you, your Guests or Visitors aftercheck-out may be dealt with by us at your cost, in any manner we choose at our sole discretion.

Number and Identity of Guests

​

You must provide the number and identity of Guests in your booking. Additional charges

apply for extra Guests not declared in advance. The rates provided per night are twin share (two Guests). If the number of Guests exceeds two people, a charge of $40 per person applies. It is the responsibility of the booking holder to inform Sol Hus of extra Guests prior to checking in. If Sol Hus is not informed of extra Guests, we reserve the right to deduct the additional Guest fee from the $300 bond.

If a gift certificate has been purchased it is the responsibility of the purchaser to inform the person they are giving the gift voucher to of all the details contained within these terms.

​

Minimum age

 

All minors must be accompanied by a parent or legal guardian. Guests are required to use a credit card in their own name to secure a booking.

​

Illegal substances

 

Strictly no illegal substances are allowed and no underage drinking is permitted at the property. Sol Hus will not be held responsible for underage drinking. Violations of this policy will result in immediate eviction without refund.

​

Pet Policy

 

To help protect the local wildlife, pets are not permitted.

​

Phone and Internet

 

Sol Hus offers complimentary wi-fi. Guests may have phone range, depending on carrier and location.

​

Smoking

Smoking is strictly prohibited indoors and within any enclosed space on the property. Do not leave butts anywhere on the property or you will incur a removal fee.

​

Visitors

Visitors are persons who visits our accommodation and is a non-paying patron. All Visitors must vacate the premises by 10 pm each evening. No camping is allowed on the site by Visitors, this includes swags, tents and caravans.

 

Noise

Keep noise levels to a minimum and adhere to local noise regulations.​

 

Eviction

 

Sol Hus reserves the right to immediately remove Guests or Visitors for violations of the booking terms and conditions. Including:

 

  • Not following the Booking Terms and Conditions

  • Ignoring requests to reduce excessive noise (music or otherwise)

  • Ignoring the restrictions on Visitors

  • Exceeding the maximum capacity of the accommodation

  • Behaviour posing a nuisance to Sol Hus staff, other guests or neighbours

  • Incidents which result in the police responding to the premises

  • Any other behaviour deemed to be inappropriate by Sol Hus staff

 

Other

It is incumbent upon our Guests to acquaint themselves thoroughly with our policies and

instructions prior to making a booking. Please note that we cannot accommodate changes or provide concessions based on a change of mind if these policies have not been reviewed in advance.

 

Privacy Policy

Your personal information will be handled in accordance with our Privacy Policy and may be used for any purpose associated with the operation of your stay.
